TERMS OF ENGAGEMENT
Arts Lab Collective Pty Ltd (“Arts Lab Collective”, “we”, “us”, “our”) provides educational workshops, incursions, creative consultancy and professional development programs delivered by qualified arts practitioners.
By engaging Arts Lab Collective, booking a program, or participating in any workshop or activity, the school, organisation, parent/guardian and/or participant acknowledges and agrees to these Terms of Engagement.
All services provided by Arts Lab Collective are educational and creative in nature. Arts Lab Collective does not provide medical, psychological, therapeutic, behavioural or clinical services, including diagnosis, treatment or counselling.
Programs are delivered in good faith and are designed to support learning, skill development, creative engagement and personal growth within an educational context.
Arts Lab Collective asserts ownership of the copyright in the materials used in its programs, workshops and activities. The parties agree that the school or other engaging organisation is not permitted to utilise these materials outside of the Arts Lab Collective programs, except for purposes related to the ongoing education of its students (and not for any commercial purposes).
RISK AND PARTICIPATION DISCLAIMER
Arts Lab Collective programs may involve physical movement, vocal activity, performance-based exercises, improvisation, emotional exploration, group collaboration and creative risk-taking.
Participation in these activities involves inherent and foreseeable risks, including but not limited to physical strain, fatigue, emotional discomfort, minor injury or personal challenge.
Participation is voluntary. Participants are responsible for engaging within their own physical, emotional and psychological limits and must follow all reasonable instructions provided by Arts Lab Collective educators.
Arts Lab Collective is not responsible for injury, loss or damage arising from, or related to:
- Pre-existing medical, physical or psychological conditions
- Failure to disclose relevant information prior to participation
- Failure to follow reasonable instructions
- Behaviour outside the scope of the program
- Activities undertaken beyond a participant’s personal capacity
CHILD SAFETY AND SUPERVISION
Arts Lab Collective is committed to providing a child-safe environment and complies with applicable Child Safe Standards and Working With Children Check requirements.
Arts Lab Collective educators and contractors are not responsible for general student supervision, behaviour management, discipline, medical care or duty of care outside the scope of the agreed program delivery.
A representative of the school or host organisation must remain present and responsible for student supervision at all times unless otherwise agreed in writing.
Responsibility for student welfare, medical needs, behavioural issues and risk management remains with the school or parent/guardian.
EDUCATIONAL OUTCOMES
Arts Lab Collective makes no guarantee regarding individual student outcomes, performance improvement, behavioural change, academic results or future opportunities.
Educational outcomes may vary depending on individual engagement, experience, aptitude and participation.
INDEPENDENT PRACTITIONERS
Arts Lab Collective may engage qualified independent contractors to deliver programs. These practitioners operate under Arts Lab Collective’s professional standards but are not employees unless stated otherwise.
LIMITATION OF LIABILITY AND INDEMNITY
To the fullest extent permitted by law, Arts Lab Collective excludes all liability for any loss, damage, cost or expense (including indirect or consequential loss) arising from participation in its programs, except where such liability cannot be lawfully excluded.
Arts Lab Collective’s total liability is limited to the amount paid for the relevant service.
The school or engaging organisation agrees to indemnify Arts Lab Collective, its directors, employees, contractors and agents against any claim, demand, loss or liability arising from, or related to:
- Student behaviour
- Failure to provide adequate supervision
- Failure to disclose relevant student information
- Breach of school policies, procedures or obligations, and
- Any other issues arising in connection with participation in the programs, which would reasonably fall within the control or responsibility of the school or engaging organisation.
Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.
